The wife is entitled to Marital Maintenance, under conditions that are:
- That the Marriage Contract be valid.
- that the wife is suitable for marital relations and to achieve the marital purposes as a whole, if she is young, it is not suitable for any of that, then there is no Marital Maintenance for her because the rights correspond to the duties.
- That the wife should not be disobedient, as the disobedient wife does not have any Marital Maintenance from her husband.
When the wife files a lawsuit against the husband (claiming dowries – Separation), she can also request a ruling for her for Four Months Marital Maintenance prior to the prosecution. Marital Maintenance is obligatory for the wife over the husband in all cases even if he is poor and the court then rules for her the Common Alimony, in addition to Three Months Alimony (Post Divorced Waiting Period) in the event of Separation.
