Personal Status Law: In Article / 109 /, it authorized the wife to request separation after a year of his absence, provided that his absence was without an acceptable excuse, but if it was with an acceptable excuse, the request for separation was not permitted.
The prisoner takes the ruling of the absentee, provided that the prison sentence for a period of three years or more, and therefore it is not permissible to request separation if the prison sentence is less than that.
It is worth noting that separation due to absence is considered a revocable divorce, whereby the husband can return to his wife if he comes back while she is still in the Widowed Waiting Period.
